Welcome to GatherUp. These Terms of Use (“Terms”) govern your use of the GatherUp mobile app and related services (“GatherUp”, “the app”, “we”, “us”, “our”).
By creating an account or using GatherUp, you agree to these Terms. If you do not agree, do not use the app.

1. What GatherUp is
GatherUp is a private invitation app. It helps you invite people you trust to meet up — for example, “right now” or “plan ahead” — and optionally share a place, photo, video, or message.
GatherUp is not a public social network. You connect with people through phone numbers or private invite links, and you control who you add as a contact. There is no public feed, directory, or discovery of strangers.
2. Eligibility
You must:
- Be at least 13 years old (or the minimum age required in your country).
- Provide a valid phone number you control.
- Use GatherUp only for lawful, personal purposes.
3. Your account
- You are responsible for activity on your account and for keeping access to your phone secure.
- You must provide accurate information (such as your display name).
- You must not share your account or verification codes with others.
- You may sign out at any time in Settings.
4. Acceptable use
You agree not to:
- Harass, threaten, abuse, or harm others.
- Send spam, unsolicited invitations, or misleading content.
- Use GatherUp for illegal activity.
- Attempt to hack, scrape, reverse-engineer, or disrupt the app or our systems.
- Impersonate another person or misrepresent your identity.
- Upload content that infringes someone else’s rights (copyright, privacy, etc.).
- Use GatherUp to stalk, surveil, or track others without their knowledge and consent.
We may suspend or terminate accounts that violate these rules.
5. Contacts and invitations
- Adding someone as a contact generally requires mutual approval, or acceptance of a private invite link where that feature is enabled.
- When you send an invitation, the recipients you choose can see the content you include (message, place, media, venue link, etc.).
- You are responsible for what you send. Do not share others’ personal information without their permission.
- Invitations are private to the sender and invited recipients — they are not posted publicly on GatherUp.
6. Content you share
You keep ownership of content you upload (photos, videos, messages). By sharing content through GatherUp, you grant us a limited license to store, display, and transmit that content only as needed to operate the app (for example, showing your photo to people you invited).
We may remove content that violates these Terms or applicable law.
7. Location, maps, and venue links
Places on invitations
If you attach a place to an invitation, location information (such as name, address, and map coordinates) is stored with that invitation and shared with the people you invite so they can find the meet-up spot. Only attach locations you are comfortable sharing with those recipients.
GatherUp does not provide live location tracking or background monitoring of where you go. Location access on your device is used only when you choose to attach a place (or to help you search and drop a pin on the map).
External links and maps
Venue links may open external websites that are not controlled by GatherUp. Map and place search may use Apple’s services on your device. Your use of those services is also subject to Apple’s terms.
8. Analytics and privacy
GatherUp uses first-party analytics to understand how features are used, fix bugs, and improve the product. Our analytics are designed to be privacy-conscious: they use aggregated and categorical information (for example, whether an invitation included a location, or the general type of place such as “park”) and do not use analytics to track your daily movements or build a history of places you visit.

9. Beta and availability
GatherUp may be released as beta or TestFlight software. That means:
- Features may change, break, or be removed.
- The app may be unavailable at times.
- Push notifications and other features may not always work.
We do not guarantee uninterrupted or error-free service.
10. Account deletion
You may delete your account at any time in the app: Settings → Delete account. Deletion is permanent and removes your profile, contacts, and invitations, as described in the Privacy Policy.
11. Disclaimer of warranties
GatherUp is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, GatherUp and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the app.
Our total liability for any claim related to GatherUp will not exceed the amount you paid us for the app in the twelve months before the claim (or AUD $100 if you paid nothing, such as during a free beta).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version at https://gatherupsocial.app/terms and change the “Last updated” date. Continued use after changes means you accept the new Terms.
14. Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-law rules. You agree to submit to the exclusive jurisdiction of the courts in Australia for disputes arising from these Terms, except where consumer law in your country gives you mandatory rights that cannot be waived.
